Christiane M. McKnight, formerly in the firm’s New York office, rejoins the firm to open a Chicago Office. Chris McKnight has been admitted to practice in Illinois and commenced her work as Manager of the firm’s new Chicago Office on May 1. Chris served as a trial litigation lawyer in the firm’s New York office for nearly 3 years. Before joining the firm, Chris was an associate at the Wiley Rein firm in Washington, DC, and completed a clerkship for the Honorable Eric L. Clay, on the United States Court of Appeals for the Sixth Circuit.

Matthew J. Chisman Joins Kaufman & Company’s Cleveland Office as Associate Attorney

Cleveland, OH – National trial and litigation law firm Kaufman & Company, LLC, welcomes Matthew J. Chisman as an associate attorney to the firm’s Cleveland office. Previously, Mr. Chisman spent four years as an associate attorney in the Business & Tort Litigation group of the Columbus, Ohio, office of Jones Day. There, his work focused on internal investigations and complex commercial litigation in areas including class actions, construction, contract disputes, and general business litigation, with a special focus on defending health care providers from actions under the federal and state False Claims Acts. Mr. Chisman also served as law clerk to the Honorable Sara Lioi of the United States District Court for the Northern District of Ohio and as judicial extern to the Honorable R. Guy Cole Jr. of the United States Court of Appeals for the Sixth Circuit.

Mr. Chisman earned his J.D. summa cum laude from the Ohio State University Moritz College of Law in 2010, where he served as Articles Editor for the Ohio State Law Journal. During law school, he received CALI Awards for the highest grades in ten courses, including Appellate Advocacy, Civil Procedure, Evidence in Trial Practice, Federal Courts, and Legal Research. He also received the Top Five Brief, Final Four Oralist, and Top Ten Overall awards in Moritz’s intraschool Herman Moot Court Competition. Mr. Chisman earned a B.A. in Philosophy with a Minor in Physics at George Mason University in 2006. He is admitted to practice in Ohio and a member of the Ohio State Bar Association.

With more than a decade of experience in litigation, Ms. Cunningham has represented clients in complex commercial matters, as well as copyright and trademark, real estate litigation, international arbitrations, securities and government investigations.

Won verdict for plaintiff, a closely-held New Jersey corporation and its Italian-based majority shareholder

After seven-week bench trial in New Jersey State Chancery Court obtained judgments in favor of client awarding substantial damages for lost profits and attorneys’ fees for breaches of fiduciary duty, breach of the duty of loyalty, theft of trade secrets and confidential information and related conspiracy, as well as and tortious interference in business opportunity. Judgments were against the company’s minority shareholder and former COO. Also, won defense verdicts as to counterclaims and third-party claims against the company and its majority shareholder. Court also found in favor of plaintiff the defendants’ spoliation of evidence and violation of the Court’s injunction order. Successfully obtained a TRO, immediately after filing the action, directing defendants to turn over all of their personal computers and electronic devices for forensic examination, as well as an order of non-competition by the former Director and preliminarily enjoining defendants from utilizing the company’s trade secrets, confidential and proprietary information.

Kaufman & Company Opens Washington, DC Office and Adds Attorney Kip Schwartz

WASHINGTON, DC – Kaufman & Company LLC, a national trial and business litigation law firm, has opened a Washington, DC office – Kaufman Schwartz & Company PLLC – and welcomes Attorney Kip Schwartz as Member, effective April 1st. This will bring the number of offices to three, with existing offices in Cleveland, Ohio and New York City. Mr. Schwartz will lead the firm’s new Washington, DC office as the Member in Charge, and will also lead client work out of the New York City office. With more than three decades of experience, Mr. Schwartz focuses his practice on plaintiff professional liability, fiduciary duty, complex commercial, partnerships and trade secret litigation. In the 1980s, he served as a trial attorney for the Federal Trade Commission, leading federal court litigation teams responsible for prosecution of civil fraud cases. In this capacity, he served as counsel to the Justice Department and various state attorney generals in criminal prosecutions of FTC respondents. “Our New York business has been steadily increasing over the last two years since opening our doors in New York,” said Steven S. Kaufman, Managing Member of Kaufman & Company. Scheiman, a well-respected litigator with more than 30 years’ experience. Mr. Scheiman will lead and serve as a Member in the New York office focusing on complex commercial and construction litigation, First Amendment, as well as IP litigation and franchising matters. Kaufman & Company is headquartered in Cleveland, Ohio. The New York office is located at 733 3rd Avenue, 16th Floor, New York, NY 10017.

Prior to joining Kaufman & Company, Mr. Scheiman served as a Partner with Arent Fox where his practice area focused on complex commercial litigation, including construction, franchising and publishing. Prior to Arent Fox, he was a partner at a New Jersey law firm, where he served as co-chair of the construction litigation practice group.

Included in Legal 500 and Who’s Who in American Law, Mr. Scheiman’s representative matters include defending the city of New York against claims of approximately $1 billion resulting from the collapse of World Trade Center 7 onto a Con Edison Power Station situated under the building on September 11. Also, he served as lead counsel in a jury trial representing one of the country’s largest mall builders, operators and owners in matters related to the fraudulent diversion of loan proceeds by associated firms and individuals involving complicated issues of RICO liability, as well as conspiracy and kickbacks.

Mr. Scheiman obtained his JD from Brooklyn Law School, graduating cum laude and obtained his BA from Long Island University.

Steven Kaufman Discusses Cleveland’s Economic State in the National Law Journal

Steven Kaufman discusses the effects of the Great Recession in the article, “‘Flat in Cleveland’ Best Describes Economy,” published by the National Law Journal. Mr. Kaufman states, “There’s an abundance of lawyers and a shrinking pie of locally produced business – more lawyers trying for less work.” Companies are carefully watching their legal spending and are less inclined to pursue claims, unless it’s critical. “In general, there’s a decline in litigation activity. Kaufman & Company Files Class Action Lawsuit Against Eight Lenders and Mortgage Servicers

Steven S. Kaufman is serving as co-counsel in a complex, multi-defendant class action lawsuit against eight lenders and mortgage servicers for fraud and violations of the Ohio Consumer Sales Practices Act. The lawsuit was filed by seven individuals on behalf of all Ohio residents who had been defendants in judicial foreclosure actions on home mortgages purportedly held by securitization trusts. These foreclosure actions were knowingly initiated and prosecuted by lenders and mortgage servicers on behalf of parties that lacked legal standing. The homeowners were damaged by defendants’ abusive foreclosure practices.

Filed in the Court of Common Pleas Cuyahoga County, Ohio and assigned to Judge Michael P. Donnelly, the complaint alleges that the defendants imposed inflated, unfair, unreasonable and/or fabricated fees for “default management services,” and prepared, executed and notarized fraudulent documents. Plaintiffs are claiming damages for fraud, conspiracy to commit fraud, slander of title, violations of the Ohio Consumer Sales Practices Act and injunctive relief.

The defendants are alleged to have acted and conspired in concert in order to generate enormous profits from default loan servicing fees. The defendants named in the July 23, 2012 complaint are Lender Processing Services, Inc.; LPS Default Solutions, Inc.; DocX LLC; Fidelity National Information Services, Inc.; American Home Mortgage Servicing, Inc.; and three Ohio-based law firms, Reimer, Arnovitz, Chernek & Jeffrey, Co. LPA; Lerner, Sampson & Rothfuss LPA; and, Manley Deas Kochaliski. The law firm of Berger and Montague serves as co-counsel.

Judge Gives Disputed Plans to Flats East Bank Project Covered by Plain Dealer

Steve Kaufmam’s victory on behalf of the developers of the Flats East Bank project was covered in the Plain Dealer. The firm obtained for the developers a preliminary injunction blocking the architects that designed the project from withholding their drawings. The architects had threatened to hold back the drawings over a billing dispute, endangering the entire $275 million project.

“We are delighted that the court has granted the project’s motion for preliminary injunction, because it now allows the project to proceed in an orderly way without any interference,” Kaufman & Co. partner Steven Kaufman told the newspaper. “This means that we are closer to realizing the vision that the developer, the Cleveland-Cuyahoga County Port Authority, the city of Cleveland and our community has for this project.”
